Introduction 

Africa Construction Law (“we, us, our”) is dedicated to shielding your privacy. We conform to the European General Data Protection Regulation (GDPR), Nigeria Data Protection Regulation (NDPR) and the Data Protection laws of the various countries where we are operate. 

This privacy statement describes the types of personal data we collect from you, how we process your personal data and your rights regarding your personal data. 

 

Your Personal data

Personal data refers to any information relating to an identified or identifiable natural person (‘data subject’). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as:

  • A name;
  • An email address;
  • A phone number;
  • An identification number;
  • Location data;
  • Billing information such as bank account details, billing address and payment information;
  • An online identifier to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

 

The types of personal data we collect from you is determined by your contact with our website and how you use of our services.

Legitimate Basis for processing your personal data

We process your personal data on the legal basis that it is obligatory to promote our legitimate interests which are rational and equitable such as: 

  1. To provide effective and innovative services to our users and members including but not limited to  preventing, detecting and addressing technical issues ; and 
  2. To comply with the provisions of the law.
  3. For the performance of a contract to which you are a party or to take steps at your request prior to the entering of a contract. 

We also process your personal data because you have out rightly given us your consent to process it for one or more specific purposes. Your personal data might be used to send newsletters, present and futuristic marketing emails of Africa Construction Law materials i.e if you give us consent to do so. You can also opt-out of the newsletter or email marketing materials at any time.  Your personal data might be used to inform you about changes to our Service. 

However, we would not process your personal data, where our interests are overridden by your interest or fundamental rights and freedoms that require protections of personal data.

We will process (collect, store and use) the information you provide in a manner compatible with the NDPR and the GDPR.

How we collect your personal data from you 

We gather personal data which you directly and on a free will basis provide to us in the following manner: 

  • When you sign-up for our newsletter, we collect your name and email address, and organisation details such as name and address. 
  • When you register for any of our events on our website, we collect your name, email address, name of organisation, address of organisation and job title. 
  • When you subscribe to our membership form on our website, we collect your name, email, name of organisation, job title, country of residence, state, city and zip or postal code. 
  • When you fill out our contact form, we collect your name and email address. 
  • When you request a partnership or collaboration with us, we shall request for information regarding the collaboration or partnership including further contact details such as email address of the contact person of the Organisation, phone number of the contact person and address of the Organisation seeking collaboration or partnership. 

 

Data we mechanically collect from you

We mechanically gather and use technical data about your activity when you visit our website. Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalise the ads of its own advertising network.

You can opt-out of having made your activity on our website available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about your visits activity.

 

Log file information

Log file information is robotically reported by your browser or mobile device each time you access our website. When you use our website, our servers mechanically record certain log file information. These server logs may include unidentified information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the website, pages viewed, and other such information.

 

Personal Data Retention

We do not hold on to your personal data if we do not have need for it. Your personal data is retained for as long as it is necessary for us to provide the services or achieve the purpose for which it was collected.

 

Your data rights 

  1. You have the right to be forgotten by requesting that we should erase your data. In cases where we have shared your data with third parties, we shall inform them about the erasure of your data, except it is not possible to do so. 
  2. You have the right to request for your data. 
  3. You have the right to rectify your data, if it is incorrect. If we have shared the data with anyone else, we will inform them about the correction wherever possible. Where it is impossible to comply with your request to modify your data, we shall inform you accordingly with reasons on why we could not modify your data. 
  4. You have the right to data portability i.e the ability for your personal data to be transferred easily from one IT system or computer to another through a safe and secure means in a standard format. 
  5. You have the right to ask us to restrict the processing of your personal data by opting out of our marketing emails or newsletters. 
  6. You have the right to object to the processing of your personal data, provided it is based on the genuine interests ground.

 

Where it is impossible to process your request, we shall promptly inform you or we shall inform you within one month of receipt of your request with reasons on why we could not process your request. Your requests as it pertains to your rights shall be carried out without charge to you except where it is excessive and unfounded, then we shall charge a reasonable fee for administrative costs of providing the information or communicating or taking the requested action or we shall write a letter to you stating our refusal to act on your request and we shall copy the Agency on such occasion. 

 

Data sharing 

We are not in the business of personal data sharing, leasing and sale to third parties. While we are dedicated to the preservation of your personal data, there are circumstances outlined below where we may need to share your personal data with third parties for purposes of internal administrative operations and for the purpose of providing the initiative services. 

We may share personal data when obligatory with relevant regulatory authorities and law enforcement authorities.  We may share your personal data when you have given us your consent to do so. 

Personal data relating to users, website visitors and members may be divulged to members of our advisory board and members of the global steering committee in their official capacity. 

We may also disclose and share personal data with our suppliers and service providers including our technical team, event organisers and partners, this is to enable them provide the services to you. 

 

Data Transfer

When it is necessary to transfer data outside of Africa Construction Law’s location – Nigeria, we will comply with any relevant data transfer obligation under the local laws of the respective jurisdictions where the data would be transferred to. Your transfer of personal data outside of Nigeria is dependent on the following:

  • The transfer is to a country or other territory which has been assessed by the Agency to have adequate level of data protection or which has been adjudged by the Honourable Attorney General of the Federation to have adequacy of safeguards or on the basis that the transfer is complaint with the NDPR and other applicable laws. 

  

Data Security 

We use our best endeavours to secure your personal data such as storing data securely with access to specific authorised individuals, employing data encryption technologies, developing organisational policy for handling personal data (and other sensitive or confidential data), protection of emailing systems. 

If there is an incident of data breach, we will take reasonable steps to investigate the situation.  Where necessary, we shall notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

Our site may have links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We advise you to review the Privacy Policy of every site you visit.

We have no control over and do not undertake any responsibility for the content, privacy policies or practices of any third-party sites or services.

 

Children’s Privacy

Our Service is not tailored for persons under the age of 18 (“Children”). We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with personal data, kindly contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we would take steps to erase that information from our servers.

 

Changes 

Our privacy statement can be reviewed from time to time to adapt to the ever changing laws and regulations. Updated version of this privacy statement will become effective as soon as it is published on the site. We shall notify you on the website if there is a change to our privacy policy.
