Thobani Mnyandu is a Director at MNS Attorneys and heads the Construction and Engineering Law Department at the firm. He specialises in all aspects of Construction and Engineering law as well as aspects of Insurance law concerning organs of State. Mnyandu has represented a broad range of public and private sector clients.
His vast experience entails drafting and advising clients on the standard forms of construction
contracts (including FIDIC Red Book, NEC3, GCC and JBCC 2000 Series Agreements). He also has extensive experience in drafting bespoke construction and engineering law agreements, with a particular focus on Turnkey Development Agreements.
Some of the major construction and engineering law projects he has led include:
- disputes in respect of Transnet SOC Ltd’s New Multi-Product Pipeline Project; and
- revising the standard forms of contracts utilised by Airports Company South Africa.
- reviewing various Supply Chain Management Policies for Infrastructure Procurement.
Mnyandu has also been involved in numerous Turnkey projects – primarily around– where he was responsible for drafting bespoke Turnkey Development Agreements for the Employer.
Mnyandu’ s practice is currently centred around advising organs of State on the implications of the Framework for Infrastructure Delivery and Procurement Management and the drafting of separate Supply Chain Management Policies for Infrastructure Procurement.
In recognition of his work, Thobani has been appointed as an external examiner at the Wits University’s School of Construction Economics and Management. He is also a member of the Construction Industry Advisory Board of the Wits University School of Construction Economics and Management.
He has been recognised as one of the Best Lawyers in construction and engineering law for five consecutive years.
